Title: What are Medicaid’s potential roles and responsibilities in the development and enforcement of consent policies for health information exchange?

Summary: Since forming last year, the Medicaid/CHIP Privacy and Security Community of Practice has addressed consent policy options several times – both for general health information exchange and for the exchange of Medicaid-controlled health information. In light of ongoing policy development and a number of requests that we have received for an event focused on consent policy, we have decided to open the next Community of Practice meeting to a broad audience. This meeting is held in collaboration/cooperation with the NASMD Multi-State Collaborative. The goal of this meeting is to provide an overview of consent policy as it applies to the electronic exchange of patient information. Specific attention will be paid to: Consent policies that have been implemented by state or regional Health Information Organizations (HIOs) and consent policies that Medicaid should consider when exchanging Medicaid claims data through an HIO or directly with providers. We will review current models in place and the second half of the meeting will be devoted to a panel discussion regarding the different consent policy options that states have implemented.
